Commissioner Blank inquired where in the conditions the requirement for an HOA was <br />located. Chair Pearce pointed out that it was in Condition No. 11. Ms. Seto noted that <br />the CC&R's must create the HOA. <br />Commissioner O'Connor noted that Condition No. 14 talks about phasing and inquired <br />why phasing for a small subdivision of five units would be required. He further inquired <br />if the applicant was proposing to phase the project. Chair Pearce indicated that this <br />was a question for the applicant. <br />Chair Pearce noted that the road is 28 feet wide, which allows for parking on one side. <br />She inquired which part of the road is anticipated for parking. Ms. Soo replied that <br />parking would be on the opposite side of the houses. In response to Chair Pearce's <br />further question if there would be signage to indicate where parking would be allowed, <br />Ms. Soo replied that the curb by the houses would be painted red and added that this <br />would be a private street. <br />Chair Pearce inquired why parking would not be available in front of the houses. <br />Ms. Soo replied that there would be more parking available on the opposite side of the <br />street due to driveway cuts on the side of the houses. <br />Chair Pearce inquired if there were any future development planned for the adjacent <br />property. Ms. Soo replied that the lot is open space and that the trail extends along the <br />area. <br />Commissioner O'Connor noted that Condition No. 31 states that construction is limited <br />to Monday through Friday, but the following sentence makes mention of future <br />complaints regarding Saturday construction. Ms. Soo acknowledged the oversight and <br />noted that staff will revise the condition to limit construction to Monday through Friday <br />only. <br />Commissioner O'Connor referred to Condition No. 51, which states that the existing well <br />will be abandoned per Zone 7 standards. He inquired whether or not the well could be <br />retained by one of the lots. Ms. Seto replied that the well can be retained, but if the <br />applicant decides to abandon it and seal it, it must meet Zone 7 standards so there is no <br />contamination of the ground water. She added that if the well is kept, there are other <br />conditions that require the installation of a backflow prevention device so City water is <br />not contaminated. <br />Commissioner O'Connor noted that the way the condition is written sounds like Zone 7 <br />is requiring that the well be abandoned. He suggested that the language be revised to <br />reflect that in the event the well is abandoned, it should be done according to Zone 7 <br />standards. <br />Commissioner Fox inquired why the street would be private and if it would have a <br />sidewalk on one side.
