CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFO~IIA <br /> <br />RESOLUTION NO. 84-359 <br /> <br />RESOLUTION VACATING PUBLIC SERVICE EASEMENT <br />FOR PEDESTRIAN ACCESSWAY <br /> <br />WHEREAS, <br /> <br />a public service easement was originally shown <br />between Lot 16 and Lot 17 of Tract 5004, Park Place, <br />to serve as a pedestrian accessway; and <br /> <br />WHEREAS, <br /> <br />the City Council has subsequently determined that said <br />accessway should be eliminated from the improvements <br />of Tract 5004; and <br /> <br />WHEREAS, <br /> <br />there are no public facilities located within the <br />easement, the easement has never been used for the <br />purpose for which it was dedicated, and the accessway <br />has been relocated; and <br /> <br />WHEREAS, <br /> <br />pursuant to Section 8333 of the Streets and <br />Code, the City may summarily vacate such an <br />and <br /> <br />Highways <br />easement; <br /> <br />WHEREAS, the proposed vacation conforms to the City's general <br /> plan; <br /> <br />NOW, THEREFORE, THE CITY COUNCILOF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1 <br /> <br />: Pursuant to Chapter 4, Part 3, Division 9 of the <br />Streets and Highways Code and based upon the above <br />findings, the public service easement described in <br />Exhibit A, attached hereto and incorporated herein, <br />is hereby vacated. <br /> <br />Section 2: The Clerk shall cause a certified copy of this <br /> resolution to be recorded in the office of the Alameda <br /> County Recorder and from and after the date the <br /> resolution is recorded, the public service easement <br /> vacated no longer constitutes an easement. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED JULY 24, 1984 BY THE FOLLOWING VOTE: <br /> <br /> <br />
