AGREEMENT: <br /> <br /> NOW, <br /> <br /> THEREFORE, the parties do agree as follows. <br />Guidelines For Newsrack Use; Permissible Newsracks. <br />A. In recognition of the unique architectural <br />features and basic heritage theme of the area bounded by the <br />westerly right-of-way line of Peters Street on the west, <br />First Street on the east, the Western Pacific railroad track <br />on the north, and Bernal Avenue on the south (the "Histori- <br />cal Business District" or "HBD"), it is agreed that all <br />newsracks located within the HBD shall be of a multi-unit <br />configuration standard in trade use permanently affixed to <br />the ground. Anything above notwithstanding, any Distributor <br />may locate single-unit, moveable newsracks in the HBD for a <br />period of not more than sixty (60) days in order to determine <br />the suitability of permanent newsrack locations. <br /> <br /> B. In any part of the City outside the HBD, news- <br />racks may be of any standard design or configuration commonly <br />in trade use, elLher single-unit or multi-unit. Such news- <br />racks may be either movable or permanently affixed to the <br />ground. Anything above notwithstanding, the Distributors <br />agree to make a good faith effort to employ multi-unit news- <br />racks ill any location outside the HBD where the circumstances <br />of such location and the number of newsracks already in place <br />at or near such location indicate that it is practical to do <br />so. It is understood that it may be impractical to employ <br />multi-unit newsracks at some locations outside the HBD <br /> <br />-3- <br /> <br /> <br />
