AGP~EEMENT ON GUIDELINES FOR <br />PLACEMENT AND ~iAINTENANCE OF NEWSRACKS <br /> <br />Date: <br /> <br />Place: <br /> <br />Parties: <br /> <br />Recitals: <br /> <br />As of July 1, 1984. <br /> <br />Pleasanton, California. <br /> <br />The City of Pleasanton, <br />"City") <br />butors <br /> <br /> California (the <br /> <br /> and the undersigned newspaper distri- <br />(collectively, the "Distributors"). <br /> <br /> The parties enter into this Agreement on the basis <br />of the following facts and understandings. <br /> <br /> A. Each of the Distributors distributes one or more <br />newspapers throughout the City by various means including by <br />way of newsracks located on public and private property and <br />within public righLs-of-way. Public rights-of-way are forums <br />traditionally associated with news distribution, and their <br />reasonable use in distributing and circulaLing newspapers by <br />means of newsracks is a right protected under both the United <br />Snates and California Constitutions. <br /> <br /> B. While the Distributors have a constitutional right <br />to distribute newspapers by means of newsracks placed and <br />mainnained on public property and within public rights-of- <br />way, the City has a legitimate interest in ensuring that <br />newsracks do not (i) unredsonably interfere with pedestrian <br />or vehicular traffic, or access to emergency and other public <br />facilities, or ingress to and egress from properties adjacent <br />to the public right-of-way, (ll) obstruct vie~s of Eraffic <br /> <br /> <br />
