Box 520 <br />Pleasanton, CA 94566 <br />(Space above reserved for Recorder's use only.) <br />LAND CONSERVATION CONTRACT <br />THIS CONTRACT, made and entered into this 20th day of January 2009, by.and <br />between DAVID THEOBALD and LINDA THEOBALD, hereinafter collectively referred to as <br />- "Owner," and the CTTY OF PLEASANTON, a municipal corporation of the State of Califomia, <br />~ hereinafter referred to as "City": <br />WITNESSETH: <br />WHEREAS, Owner possesses certain real property located within City and described in <br />Exhibit A attached'hereto and made a part hereof; and <br />WHEREAS, said property is devoted to agricultural and compatible uses; and <br />WHEREAS, on Febmazy 5, 1976, said property was made subject to a land conservation <br />contract, entered into between Owner's predecessor in interest, the Estate of Ernest Fenazio, and <br />the County of Alameda (the "County") pursuant to the Califomia Land Conservation Act <br />(Government Code § 51200 et seq.) and filed in the Office of the Recorder of the County of <br />Alameda on Februazy 26, 1976 in book 4272, page 180 jthe "Initial Contract"). <br />WHEREAS, in October 2008, the County of Alameda Local Agency Formation <br />Commission issued a Certificate of Completion finalizing City's annexation of said property. <br />WHEREAS, upon annexation of said property, the City succeeded to the County's rights <br />and obligations under the Initial Contract, pursuant to Government Code § 51243. <br />WHEREAS, [o facilitate a lot line adjustment, the Owner and City desire to rescind the <br />initial Contract and concurrently enter into in this contract, pursuant to and in accordance with <br />Government Code § 51257. <br />- Y <br />'" WHEREAS, at a properly noticed public hearing conducted on January 20th, 2009, the <br />City Council of the City (the "City Council") adopted Resolution Number 09-257 approving <br />City's execution of this contract, concurrently rescinding the Initial Contract and, on the basis of <br />substantial evidence set forth in [he administrative record, finding as follows: <br />EXHIBIT C~ <br />
