CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 84-348 <br /> <br />RESOLUTION VACATING A PORTION OF OAKLAND AVENUE <br /> <br />WHEREAS, <br /> <br />on June 12, 1984, the City Council received a staff <br />report recommending the vacation of a portion of <br />Oakland Avenue, more particularly described on Exhibit <br />"A" attached hereto and by this reference incorporated <br />herein; and <br /> <br />WHEREAS, on June 12, 1984, Council adopted a resolution of <br /> intention to vacate the portion of street; and <br /> <br />WHEREAS, the appropriate notice was given pursuant to Streets <br /> and Highways Code §8300, et seq.; and <br /> <br />WHEREAS, <br /> <br />a public hearing was held at which time the public was <br />given the opportunity to comment on the proposed vacation <br />of a portion of Oakland Avenue; and <br /> <br />WHEREAS, <br /> <br />the City Council determines that the above-described <br />portion of Oakland Avenue is unnecessary for present or <br />prospective public use upon relocation of the utilities <br />presently existing therein; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: That the portion of Oakland Avenue, more particularly <br /> described in the attached Exhibit "A" and incorporated <br /> herein by this reference, is hereby vacated upon the <br /> satisfaction of the following conditions: <br /> <br />that all utilities located within the portion of <br />Oakland Avenue to be vacated shall be relocated to <br />the westerly thirty foot portion of Oakland <br />Avenue; and <br /> <br />that the westerly thirty foot portion of Oakland <br />Avenue, as more particularly described in the <br />attached Exhibit "A", shall be reserved as a <br />public service easement. <br /> <br />Section 2: The City Manager is hereby directed that the resolution <br /> of vacation not be recorded until the above conditions <br /> have been satisfied. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
