The City finds that the following mitigation measure is feasible and has <br />been incorporated into the MMRP, thereby mitigating the impact to a <br />less-than- significant level: <br />Develop a construction access plan to be reviewed and approved by <br />the City's Engineering Department, per MM TR-12.1. <br />DEIR, p. 3.9-46 <br />Findings Demonstrating No Need for Recirculation <br />1. Effect of Concurrent Extension on Transportation and Traffic <br />Revising the Project to include the Concurrent Extension would not require <br />recirculation because this revision would not result in new significant <br />transportation impacts or intensify the severity of transportation impacts <br />beyond those already disclosed and assessed in the Draft EIR. <br />As a threshold matter, many of the project-level impacts analyzed in the <br />transportation analysis of the Draft EIR are independent of the Deferred <br />Extension, and are therefore the same whether the Extension is Deferred <br />or Concurrent. These impacts include Impact TR-4 (air traffic patterns, <br />Draft DEIR, page 3.9-40), Impact TR-5 (BART expansion, Draft EIR, page <br />3.9-40), Impact TR-6 (design feature and incompatible use hazards, Draft <br />EIR, page 3.9-41), Impact TR-7 (emergency access, Draft EIR, page 3.9- <br />42), Impact TR-8 (parking capacity, Draft EIR, page 43); Impact TR-9 <br />(alternative transportation, Draft EIR, page 43); Impact TR-10 (freight and <br />truck traffic, Draft EIR, page 45); TR-11 (neighborhood residential streets, <br />Draft EIR, page 46); and Impact TR-12 (construction traffic, Draft EIR, <br />page 46). <br />Certain other project-level transportation impacts may differ in the event <br />the Project is revised to include the Concurrent Extension. As indicated <br />below, the identification of these five Concurrent Extension Impacts do not <br />constitute "new significant information" requiring recirculation of the EIR <br />because the Draft EIR's cumulative analysis and Existing Specific Plan <br />Alternative analysis already identify and assess them. <br />Further, the EIR's supporting traffic study verifies the conclusion that the <br />EIR already analyzes the effects of the Concurrent Extension. While the <br />Draft EIR transportation analysis assumes, and therefore focuses on, the <br />Deferred Extension, it explains that the Stoneridge Drive Specific Plan <br />Amendment -Staples Ranch Technical Memorandum for Traffic and <br />Circulation, December 7, 2007, revised March 20, 2008 (the "Staples <br />Stoneridgc Drive Specific Plan Amendment and Staples Ranch Project <br />linvironmental Impact Report Findings and Statement of Overriding Considerations Page 33 of 47 <br />
