CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 00-005 <br /> <br />RESOLUTION DENYING THE APPEAL AND THEREBY <br />UPHOLDING THE DECISION OF THE PLANNING <br />COMMISSION TO APPROVE A MODIFICATION TO AN <br />APPROVED LANDSCAPE PLAN FOR THE HOME <br />LOCATED AT 417 SYCAMORE ROAD <br /> <br />WHEREAS, at its meeting of October 27, 1999, the Planning Commission upheld the Zoning <br /> Administrator's approval of a modification to the approved landscape concept plan <br /> for the Keane residence located at 417 Sycamore Road; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, Larry and Suzan <br /> Dingman (the adjacent neighbors) filed an appeal of the Planning Commission's <br /> decision; and <br /> <br />WHEREAS, zoning for the property is PUD-MDR (Planned Unit Development - Medium <br /> Density Residential) District; and <br /> <br />WHEREAS, actions of this nature are categorically exempt from the requirements of the <br /> California Environmental Quality Act (CEQA); therefore, no environmental <br /> document was prepared for this proposal; and <br /> <br />WHEREAS, the City Council determined that the proposed modification to the approved <br /> landscape plan is appropriate. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />AS FOLLOWS: <br /> <br />RESOLVES <br /> <br />Section 1: <br /> <br />Denies Case PAP-01, thereby upholding the Planning Commission's approval of <br />the modification to the approved landscape concept plan for the Keane residence <br />located at 417 Sycamore Road. <br /> <br />Section 2: <br /> <br />The City Clerk shall forward a certified copy of this resolution to the appellant <br />with a notice that they have ninety (90) days following the date of adoption of this <br />resolution in which to seek judicial review of this action of the City Council. <br /> <br /> <br />
