W.z{ker <br /> C~y Clerk <br /> <br /> 2293 ~0H rU~Z~ ~OA9 ~OVS~ OS~GA~O~S <br /> <br />WHEREAS, <br /> <br />a Deferred Street Improvement Agreement dated <br />December 13, 1977 was entered into between the <br />City and Castlewood Enterprises which required <br />certain street improvements based upon the frontage <br />of the parcel on the street to be improved; and <br /> <br />WHEREAS, <br /> <br />Lots A and B of Parcel Map 2293 have been resubdivided. <br />Parcel B of Parcel MaD 2293 has been resubdivided by <br />Parcel Map 3529 and Parcel A of Parcel Map 2293 is in <br />the process of being subdivided into four lots via <br />Parcel Map 3612 (approved but not yet recorded. Parcel <br />Map 2293 contains frontage along Foothill Road and <br />Bernal Avenue subject to the above agreement; and <br /> <br />WHEREAS, <br /> <br />$29,658.40 has been offered to the City of Pleasanton <br />in lieu of owners improvement and reservation obligations <br />relating to Foothill Road and Bernal Avenue as set forth <br />in the Deferred Street Improvement Agreement dated <br />December 13, 1977 and Condition 15 of Planning Conmxission <br />Resolution No. 1524. Specifically, payment is intended <br />to be in lieu of owners obligation to continue to <br />reserve any lands for future street widening which <br />have not already been dedicated by owner and in lieu <br />of owners obligation to improve said lands for street <br />purposes; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council hereby releases those lands (formerly <br /> Parcels A and B of Parcel Map 2293) from any further <br /> street improvement obligations contained in the Deferred <br /> Street Improvement Agreement dated December 13, 1977. <br /> <br />Section 2: The City Clerk is directed to cause this resolution <br /> to be recorded with the Recorder of Alameda County. <br /> <br />Section 3: This resolution shall become effective inmediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED JUNE 26, 1984 BY THE FOLLOWING VOTE: <br /> <br />AYES: <br />NOES: <br /> <br />Councilmembers - Brandes, Butler, Mohr, Wood and <br />Mayor Mercer <br />None <br /> <br /> <br />
