CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 84-325 <br /> <br />RESOLUTION APPROVING APPEAL OF STANLEY CHERRY TO A <br />DECISION OF THE DESIGN REVIEW BOARD LIMITING THE <br />SIZE OF AN OUTDOOR DISPLAY IN FRONT OF THE BIG "0" <br />TIRE STORE AT 3688 WASHINGTON STREET <br /> <br />WHEREAS, <br /> <br />at its meeting of March 14, 1984, the Design <br />Review Board limited the size of the tire and rim <br />display in front of Mr. Cherry's place of business; <br />and <br /> <br />WHEREAS, <br /> <br />within the time specified by the Ordinance Code of <br />the City of Pleasanton, the applicant submitted an <br />appeal to the decision of the Design Review Board <br />to the City Clerk of the City of Pleasanton; and <br /> <br />WHEREAS, <br /> <br />at its meeting of June 26, 1984, the City Council <br />reviewed a report dated June 19, 1984 (SR 84:347) <br />from the Director of Planning and Community Develop- <br />ment together with copies of staff reports to the <br />Design Review Board regarding this matter; and <br /> <br />WHEREAS, <br /> <br />the City Council held a public hearing at which <br />time the applicant and any other member of the <br />public was offered an opportunity to present <br />evidence regarding this appeal; and <br /> <br />WHEREAS, <br /> <br />the Council finds that the proposed display of tires <br />and rims are a decorative display within the meaning <br />of Section 2-7.07(b)(3) and that said display is not <br />detrimental to the public health, safety or general <br />welfare; and <br /> <br />WHEREAS, <br /> <br />upon close of the public hearing, Council deliberated <br />on this appeal; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves the appeal of Stanley Cherry to a <br /> decision of the Design Review Board limiting the <br /> size of an outdoor display in front of the Big "O" <br /> Tire Store at 3688 Washington Street and allows an <br /> outdoor display of tires not to exceed 45 sq. ft <br /> in area. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
