Acceptance of Parcel J <br />Parcel J within this development serves as a paved emergency vehicle access <br />easement (EVAE) between Royal Creek Court and Deer Creek Court. This parcel is 20 <br />feet wide by 68 feet long. Parcel J was shown as an EVAE on the final map for tract <br />7255 and was accepted with the other offers of dedication on the final map, however, <br />maintenance of the roadway within the EVAE was never determined. It was the <br />developer's intention that EVA roadway would be maintained along with the other <br />streets within the development. Since there is no maintenance association for the <br />subdivision, it only makes sense that the City would accept the roadway maintenance <br />for the EVA. To clarify the maintenance responsibility of the EVAE, the developer is <br />intending to dedicate Parcel J in fee title to the City. City staff believes this request is <br />reasonable and recommends the offer be accepted. The cost to maintain this small <br />stretch of pavement is de minimus. <br />Remaining Bernal Avenue Improvements/Acceptance of $915,000 <br />The core off-site improvements for this project have been accepted by the City with the <br />exception of a portion of the Bernal Avenue improvements. The core improvements <br />included improvements on Valley Avenue, Bernal Avenue, the Valley Avenue <br />Underpass, storm water detention basins, traffic signals, and other infrastructure <br />improvements to serve the Bernal Property development. These improvements were the <br />responsibility of BIC. <br />Development of the Bernal Property requires improvements along Bernal Avenue, <br />including street widening, traffic striping and paving. The construction of a second bridge <br />on Bernal Avenue across the Arroyo de la Laguna is necessary in order to complete <br />these improvements. The second bridge is anticipated to be constructed sometime in <br />the future. At this time, interim improvements on Bernal Avenue have been constructed <br />in order to facilitate traffic for Tract 7255 and the Windsor development located north of <br />Bernal Avenue at Meadowlark Drive. <br />The City has acknowledged that the remaining Bernal Avenue improvements cannot be <br />constructed until such time as the second Bernal Avenue Bridge is constructed and that <br />the date of that construction remains uncertain.
