ARTICLE A-11. AUDITS The Grantee agrees that those matters connected with the performance of any work done under contract pursuant to this agreement, including, but not limited to, the costs of administering the Contract, shall be made subject to the examination and audit of the California Auditor Genera] or State's other designated agent for a period of three years after final payment under such Contract. ARTICLE A-12. NATIONAL LABOR RELATIONS BOARD In accordance with Public Contract Code Section 10296, the Grantee declares under penalty of perjury that no more than one final, unappealable finding of contempt of court by a federal court has been issued against the Grantee within the immediately preceding two-year period because of the Grantee's failure to comply with an order of a federal court which orders the Grantee to comply with an order of the National Labor Relations Board. ARTICLE A-I.~. WORKER'S COMPENSATION Grantee affirms that it is aware of the provisions of Section ..~700 of the California Labor Code which require every employer to be insured against liability for workers' compensation or to undertake self-insurance in accord- ance with the provisions of that Code, and Grantee affirms that it will comply with such provisions before co~rmencing the performance of the work under this Contract. ARTICLE A- 14. CHARGES Grantee agrees that no substantial change in Project work will be permitted without prior written approval of the State Project Manager. In no event shall the Grantee substantially change the scope of the Project, provide for work which increases the cost of the Project, or provide for extension of the completion date of the Project without such written approval. ARTICLE A-15. AMENDMENTS This Contract may be amended at any time by mutual agreement of the parties, except insofar as any proposed amendments are in any way contrary to applicable law. ARTTCLE A- 16. TERMINATION This Contract may be terminated prior to completion, by the State, acting through its Project Manager, at its option, where it appears that there will be a lack of Clean W~ter and Water Conservation Bond L~w of 1978 funds available to fulfill this Contract, provided that after such termination, the Grantee shall be entitled to an amount which equals the Eligible Project Costs which have actually been incurred by the Grantee prior to such termination. 16 Contract B-550~
