ARTICLE A-V. INSPECTION OF PROJECT, BOOKS, RECORDS AND REPORTS BY STATE The Grantee, its agents and its subcontractors shall ensure thst the Department of Water Resources and the State Water Resources Control Board, or any authorized representative, will have suitable access to the Project site st all. reasonable times during Project operation and for the term of the Con- tract. The State may observe field work being performed by the Grantee or its agents, whenever such work may occur. D~ring regular office hours, e~ch of the parties hereto and their duly authorized representatives shall have the right to inspect and to make copies of any books, records, or reports of the other psrty pertaining to this Contract or matters related hereto. Each of the parties hereto shsl]. maintain and shall make available for such inspection accurate records of all of its costs, disbursements and receipts with respect to its activities under this Contract. ARTICLE A-8. CONTRACT DISBURSEMENTS Cost Statements Ax~er the basic conditions precedent in Section 3 of this Contract are met, disbursement of the whole or portions of the Contract Commitment will be made to the Grantee following receipt from the Grantee of a statement or statements of incurred Eligible Project Costs on forms provided by the State. Cost statements shall be submitted in accordance with Exhibit E. Requests for funds shall be filed following submission and approval of the Water Audit Report and Final Project Reports as specified in Section 3, Task IV, "Project Reports." (b) Disbursement Following review and approval by the State of each statement of costs (submitted in accordance with Exhibit E), the State will disburse to the Grantee the amount approved, subject to the availability of funds. Any and sll money disbursed to the Grantee under this Contract snd any and all interest earned by the Grantee on such money shall be used solely to repay expended Eligible Project Costs. (c) Withho.].ding of Disbursement by Grantee for Subcontracts The Grantee shal_] withhold not less than ten percent (10%) from any disbursement or combination of disbursements until completion of the Project or any component contract which has been Iet. Task l, Item 11 is less than 1.0 (1), the Project will be discon- nued. The State will reimburse the Grantee for the expended Eligible Project Costs of the Water Audit up to the amonnt for the Water Audit in Section 5 of this Contract. 7h, e G~antee will not be eligible for grant funds for the Leak Detection portion of the Project, and the Project will be terminated.
