"" CITY COUNCIL AGENDA REPORT <br />®L~~S~4NTON. <br />F°~~ ,' 'nn° February 17, 2009 <br />Community Development <br />Planning Division <br />TITLE: PAP-131 (PCUP-224), CONSIDER AN APPEAL OF THE PLANNING <br />COMMISSION'S APPROVAL OF A CONDITIONAL USE PERMIT TO <br />ALLOW A TUTORIAL SCHOOL IN AN EXISTING BUILDING LOCATED <br />AT 5925 WEST LAS POSITAS BOULEVARD, SUITE 200 <br />SUMMARY <br />This is an application by Jennifer Zheng for a Conditional Use Permit to operate Little <br />Ivy League school, a tutorial facility for 90 children in Grades K-8, at the existing Korean <br />Presbyterian Church of the Tri-Valley located at 5925 West Las Positas Boulevard, <br />Suite 200. The facility provides tutoring on a variety of English and Math subjects with a <br />special focus on Chinese language and culture. On December 10, 2008, the Planning <br />Commission, on a 4:1 vote, approved the proposed use with conditions of approval <br />requiring first aid and CPR training and background checks for employees, and <br />provisions for daily exercise for students during summer and school break sessions. <br />Planning Commissioner Fox appealed the Planning Commission's approval to the City <br />Council (Attachment 6). <br />PLANNING COMMISSION ACTION <br />Approved Conditional Use Permit Case No. PCUP-224, subject to the conditions of <br />approval as shown in Exhibit B of Attachment 1. <br />RECOMMENDATION <br />Staff recommends that the City Council adopt the attached draft resolution denying the <br />appeal, thus upholding the Planning Commission's approval of Case No. PCUP-224, <br />subject to the conditions of approval as shown in Exhibit B of Attachment 1. <br />FINANCIAL STATEMENT <br />No fiscal impact to the City or public services is anticipated. <br />
