CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 84-266 <br /> <br />RESOLUTION APPROVING REMOVAL OF LOW BID FOR PROJECT NO. <br />84-7 AND DIRECTING STAFF TO PREPARE ANOTHER REPORT <br /> <br />WHEREAS, <br /> <br />the City prepared plans and specifications for the <br />railroad consolidation project, Project No. 84-7; and <br /> <br />WHEREAS, <br /> <br />pursuant to Government Code §37900, et seq., the City <br />Engineering Services Division advertised for bids <br />regarding this project; and <br /> <br />WHEREAS, <br /> <br />bids were reviewed by the City Council on June 12, <br />1984; and <br /> <br />WHEREAS, <br /> <br />the apparent low bidder indicated he had made an error <br />on his bid and has submitted a letter requesting the <br />withdrawal of his bid based upon mistake; and <br /> <br />WHEREAS, <br /> <br />the City Manager recommended that the Council accept <br />the letter of withdrawal as required by Section 5100 <br />et seq. of the Public Contracts Code and direct staff <br />to analyze the bid protest by the third low bidder <br />against the second low bidder and report back at the <br />next Council meeting with a revised recommendation <br />relative to this item; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Council accepts the removal of the low bid by Gradeway <br /> Construction Company for the Railroad Consolidation, <br /> Project No. 84-7, and instructs staff to prepare another <br /> report relative to this matter for consideration on <br /> June 26, 1984. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED JUNE 12, 1984 BY THE FOLLOWING VOTE: <br /> <br />AYES: <br /> <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Councilmembers - Brandes, Butler, Mohr, Wood and <br />Mayor Mercer <br />None ~~~ <br />None ' <br />None <br /> <br /> R.
