CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 84-235 <br /> <br />RESOLUTION OPPOSING AB 12 REGARDING HAZARDOUS <br />WASTES UNLESS AMENDED <br /> <br />WHEREAS, <br /> <br />at its meeting of May 8, 1984, Council received <br />the report of the City Attorney regarding AB 12 <br />which proposes regulations of storage and transporting <br />hazardous wastes; and <br /> <br />WHEREAS, <br /> <br />after a review of the report, Council determined <br />that this legislation should be opposed unless <br />amended to address the four stated concerns; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> The City Council hereby opposes the adoption of <br />Assembly Bill 12 regarding hazardous waste storage <br />and transportation unless amendments are made to <br />address the following concerns: <br /> <br />Present state law standards pertaining to <br />generation, storage, transportation, and <br />disposal of hazardous wastes should be carefully <br />reviewed by appropriate technical committees. <br />New adequate standards must be developed. <br /> <br />A vehicle for the formulation of regional <br />disposal sites should be devised. <br /> <br />State and local law regarding the general <br />plan process should be left as it exists <br />pertaining to hazardous waste disposal facility <br />siting. <br /> <br />Responsibility for the enforcement of existing <br />rules and regulations should be delegated to <br />local government along with appropriate <br />program funding mechanisms. (The $2,500,000 <br />alloted to this program by AB 12 works out to <br />less than $44,000 per county for plan Dreparation <br />only. This is hardly enough for such a <br />complex issue). <br /> <br />Section 2: Staff is directed to contact the appropriate <br /> legislators to indicate the City's opposition to <br /> AB 12. <br /> <br /> <br />
