CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 84-232 <br /> <br />APPROVAL OF LOW-INCOME HOUSING EXEMPTION FOR <br />AMADOR ASSOCIATES <br /> <br />WHEREAS, <br /> <br />Amador Associates have requested a lower-income <br />housing exemption under Section 2-20.04 of the <br />Growth Management Ordinance for ten units of a 40 <br />unit residential project at 3780 Vineyard Avenue; <br />and <br /> <br />WHEREAS, <br /> <br />currently the City has 17 units remaining in the <br />lower income set aside under the Growth Management <br />Program; and <br /> <br />WHEREAS, <br /> <br />the Director of Planning and Connnunity Development <br />presented his report (SR 84:255) regarding the <br />request from Amador Associates which analyzed the <br />request and made several recommendations; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> Approves the low-income housing exemption for <br />Amador Associates, to be implemented through an <br />agreement between the City and the developer <br />incorporating the following elements: <br /> <br />Fifteen (15) year rent limitation on the <br />designated units. Flexibility should be <br />allowed over time to allow shifting of such <br />designation. <br /> <br />Rent adjustments may be allowed annually <br />based upon HUD income guidelines. <br /> <br />The developer and its successors shall be <br />responsible for yearly status reports on the <br />administration of the lower income units <br />within the project. Such reports will include <br />information on occupancy and income of tenants. <br /> <br />Otherwise in accordance with Resolution No. <br />82-66 Exhibit A as amended to date. <br /> <br />Section 2: <br /> <br /> The City Attorney is directed to draft the <br />agreement cited above and the Mayor is authorized <br />to execute such agreement, which is to run with <br />the land to ensure that the lower-income restrictions <br />are effectively carried out. <br /> <br /> <br />
