Upon completion of the underground supporting structure, Pacific shall proceed with all work necessary to place Pacific's communication facilities and shall from time to time thereafter perform other work necessary to furnish communication services to its customers and applicants for communications services within the District subject to the condition that, in accordance with Pacific's tariffs, rules and_. regulations on file with the Public Utilities Commission of the State of California, affected property owners are reguired by suitable legislation, or all such property owners agree writing, to provide and maintain and do provide and maintain the necessary underground supporting structure on their properties in accordance with Pacific's specifications. 5. Pacific shall remove its existing aerial communication facilities which have been replaced with underground facilities hereunder when (a} affected property owners have provided underground supporting structures on their properties in accordance with paragraph 4 above, and service to customers within District has been provided by means of such underground facilities: and (b) PG&E has removed its facilities froln such poles and anchors as are jointly owned by Pacific and PG&E and which are to be removed by Pacific. 6. Title in and to said underground communication facilities shall vest in Pacific and as to thatportion'of the underground supporting structure covered under Pacific's Rule 32.I.B. (Schedule Cal. P.U.C. No. 36-T), City agrees not to contest Pacific's title hereto. 7. Upon completion of the underground supporting structure for said underground communication facilities, City shall pay Pacific promptly after receipt of Pacific's bill therefor of Pacific's costs of constructing said underground supporting structure. The amount to be paid by City is, as of the date of this Agreement, estimated'to be Seventeeh ThOusand Five Hundred Dollars ($17,500.00).
