That entitlement has ex.~i~-ed <br />by it~ own ~.erms. The 1969 Interlocutory ,ludgment provide,~:. <br />Fleasant:on '~,i1. I ~rovide in time for occur~ancV sewer and water <br /> <br />facilities ~nc!udin.~:~ finre hydrants and ~ther necessary appurter~- <br />ances, all adequately sized to serve specified parcels (section 6 <br />(A) (3) and s;ection 6 (B) (2)) . <br /> <br /> b. In complete resolut:ion of any and all potential <br /> <br />disputes bet:ween the parties relating to sewer caoacity, Pleasanton <br /> <br />shall reserve for the benefit of lands owned by San Francisco or <br />successors in interest 26,000 gallons per day (average dry <br />wea~_her f]o~7) of existing sewer treatment capacity (the "Reserve <br />Capacity"). This Reserve Ca.oacitv shal] be used exclusively <br />within lands owned by San Francisco, or its successors in interest, <br /> <br />east of the Western Pacific railroad tracks or Parcel A-2 (as <br /> <br />shown on Exhibit B). <br /> <br /> c. Any Reserve Capacity used on the specified <br /> <br />lands shall be deducted from the 26,000 gal]ons per day allocation <br />until that allocation is entirely used up. Upon exhaustion of <br />the Reserve Capacity, then San Francisco shall have the right to <br />sewer capacity pursuant to Pleasanton's first-come, first-served <br />policy. <br /> <br /> d.
