San Francisco and ~]easanton shall work <br />5 cooperatively to develop a planned ~nit development for the <br />~ property specifying appropriate intensity of' land use D. Ot tO <br />' exceed thirty percent (30%) floor area ratio, m~xes of land uses, <br />8 height not greater than two sto~'ies, architectural treatments and <br />9 other appropriate controls. <br />I0 8. Hold Harmless. Pleasanton shall compensate all <br />11 persons for personal inj-Gries o'r propert~ damage to which such <br />12 persons; may be legally entitled and which result from Pleasanton's <br />13 construction activities during and in connection with the street <br />]4 improvements, and agrees to hold San Francisco harmless and free <br />l~ from any and all liability or costs resulting fron~ the aforesaid <br />16 activity. <br />17 9o Limitation on San Francisco Obligations. San <br />18 Francisco shall not be obligated for any costs or other expenses <br />19 whatsoever in connection with the street improvement plan referred <br />20 to in Section 2 or for any obligation for any costs or other <br />21 expenses whatsoever in connection with the Civic Center site for <br />22 which the aforesaid Action No. 385589 was filed. <br /> <br />2~ 10. Miscellaneous. <br /> <br />2~ a. Findings of Fact and Conclusions of Law, <br /> <br />?~ Trial by Jury, Notice of Time and Place of Trial and Notice of <br />26 Entry of Judgment have been waived by the parties. <br />27 b.
