CONDOMINIUM CONVERSION AGREEMENT <br /> <br /> THIS AGREEMENT is made and entered into this 8th day of May, <br />1984, by and between THEODORE R.VINTHER and .MARY A. VINTHER <br />("Developer") and the CITY OF PLEASANTON, a municipal corporation <br />("City"). <br /> <br /> WITNESSETH <br /> <br /> WHEREAS, the Developer is the owner of a acre parcel <br /> <br />of land located at 4359 Fairlands Drive and described in Exhibit <br />A, attached hereto and incorporated herein by this reference <br />(the "Property"); and <br /> <br /> WHEREAS, the Developer owns an apartment complex consisting <br /> <br />of six dwelling units (the "Complex") located on the Property, and <br />Developer has sought and received City approval for the conversion <br />of the Complex into six condominium units (the "Project"). Tentative <br />subdivision approval was subsequently granted by'the City (Tentative <br />Tract 5168); and <br /> <br /> WHEREAS, the City's Condominium Conversion Projects Ordinance <br />(the "Ordinance") requires the Developer to enter into an agreement <br />incorporating the terms and conditions of the conversion approval <br />prior to filing a final subdivision ma~, and this requirement was <br />incorporated into the approval of Tentative Tract 5168 as Condition <br />No. 6; and <br /> <br /> ~{EREAS, the Developer's obligations and requirements contained <br />herein are express conditions of approval of the Project and the <br />City would not have granted approval of the Project without the <br />Developer's acquiescence in these obligations and requirements; and <br /> <br /> <br />
