NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The City of Pleasanton endorses the design and construction of the Export Capacity Expansion Facilities at this time. Section 2: That the City of Pleasanton declares it to be its Dolicy that its share of the cost of constructing such Export Capacity ExDansion Facilities to disDose of additional treated wastewater from the City of Pleasanton shall be borne by new development within the City of Pleasanton utilizing such Export Capacity Expansion Facilities, and not by means of any increases in taxes, user or service fees of residents or owners of developed property within the City of Pleasanton. Section 3: That the City of Pleasanton, subject to the availability of funds from property owners desiring to utilize such Export Capacity Expansion Facilities, shall advance the cost for its share of any such facilities and any facilities that are necessary at this time to insure the availability of such capacity for either of the other two Member Agencies who may not desire to participate in the Export Capacity Expansion Facilities at this time, subject to future reim- bursements on fair and equitable terms and conditions. Section 4: That the City of Pleasanton requests that the City of Livermore and Dublin San Ramon Services District and the Livermore-Amador Valley Water Management Agency adopt concurring or similar resolutions at the earliest practicable date. Section 5: This resolution shall become effective immediately uDon its passage and adoption.
