Concurrently with the relocation and widening of <br /> <br />Pimlico Drive, acquisition of the necessary right-of-way for <br />future Santa Rita Road interchange improvements in the southeast <br />quadrant of said interchange is required due to the nature <br />of the Pimlico Drive relocation. <br /> <br /> D. Construction of the Pimlico Drive improvements <br /> <br />requires certain property acquisitions in order to secure the <br />necessary rights-of-way and other interests for (i)the relocated <br />and widened Pimlico Drive and (ii) the future interchange, as <br />shown on the plats attached hereto as Exhibit "A". City exercise <br />of its powe~ of eminent domain may be required to secure the <br />necessary rights-of-way and other interests if acquisition of <br />those lands cannot be secured by other means. <br /> <br /> E. The improvements to be constructed at Pimlico Drive and <br />the future Santa Rita Road interchange will benefit the development <br />of Hacienda Business Park, and such improvements are contemplated <br />by the parties to be within the scope of the purpose for which <br />the North Pleasanton Improvement District will be formed and will <br />be a portion of the major improvements to be financed by the <br />North Pleas~nton Improvement District. <br /> <br /> F. The purpose of this Agreement is to set forth the <br />understanding of the parties relating to the payment, financing, <br />and extent of the acquisition of the necessary rights-of-way and <br />other interests to accomplish the construction of the Pimlico <br />Drive relocation and widening and the Santa Rita Road interchange. <br /> <br /> <br />
