CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 84-181 <br /> <br />RESOLUTION DECLARING PARCEL IN FOOTHILL KNOLLS AS <br />SURPLUS AND APPROVING AGREEMENT RE PRIVATE PARK <br /> <br />WHEREAS, <br /> <br />Foothill Knolls is an 80-unit development located <br />on a 43 acre site located on the east side of <br />Foothill Road approximately 4,000 feet north of <br />Bernal Avenue adjacent to 1-680; and <br /> <br />WHEREAS, <br /> <br />as a condition of approval, the owner was required <br />to dedicate to the City lands for an approximately <br />1.75 acre park; and <br /> <br />WHEREAS, <br /> <br />the present developer, Falcon Development Company, <br />has proposed a park which would invite various <br />recreational uses and would require a high level <br />of maintenance; and <br /> <br />WHEREAS, <br /> <br />Falcon Development Company has proposed purchasing <br />the land back from the city, developing the park <br />as a private park, providing a public recreational <br />easement to the park in perpetuity, and providing <br />for park maintenance through a Foothill Knolls <br />Owners Association; and <br /> <br />WHEREAS, <br /> <br />the proposal of Falcon Development Company was <br />considered by the Park and Recreation Commission <br />at its meeting of March 21, 1984 and it recommended <br />approval of this plan; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> Declares that the parcel of land (approximately <br />1.75 acres) located in Foothill Knolls between the <br />1-680 freeway and the parallel subdivision street, <br />subject to an easement for park and recreation <br />purposes, as surplus. <br /> <br />Section 2: <br /> <br /> The City determines that the fair market value <br />for the property, subject to the easement and <br />obligation to maintain, is $75,000. <br /> <br />Section 3: <br /> <br /> The City Council finds that because of the <br />location and configuration between 1-680 and the <br />adjacent residential parcel (Tract 5065), the only <br />practical us of said parcel is as plottage to <br />Tract 5065. <br /> <br /> <br />
