15.44.070 any provision of this chapter, or failure to comply with any of the mandatory requirements of [his chapter shall constitute a misdemeanor; except that notwithstanding any other provisions of [his chapter, any such violation constituting a misdemeanor under this chapter may, in the discretion of [he operations services director, be charged and prosecuted as an infraction or may be is- sued an administrative citation. G. Penalty for Violation. 1. Upon conviction of a misdemeanor, a person shall be subject to payment of a fine or imprisonment, or both, not to exceed [he limits set forth in California Government Code Section 36901. 2. Upon conviction of an infraction, a person shall be subject to payment of a fine, not to exceed the limits set forth in California Government Code Section 36900. Subsequent violations may be charged as a mis- demeanor. 3. Continuing Violation. Unless otherwise pro- vided, aperson shall be deemed guilty of a separate of- fense for each and every day during any portion of which a violation of this chapter is committed, contin- ued or permitted by the person and shall be punishable accordingly as herein provided. H. Authority to Arzest or Issue Citations. The Operations services director shall have and are hereby vested with [he authority to arrest or cite any person who violates any section of this code in the manner provided by the California Penal Code for the arzest or release on citation of misdemeanor infractions as prescribed by Chapters 5, Sc and Sd of Title 3, Part 2 of the Penal Code (or as the same may be hereinafter amended). The operations services director may issue a cita- tion and notice to appear in the manner prescribed by Chapter Sc of Title 3, Part 2 of the Penal Code, includ- ing section 853.6 (or as the same may hereafter be amended). It is the intent of the city council that the im- munities prescribed in Section 836.5 of the Penal Code be applicable [o public officers or employees or employ- ees acting in the course and scope of employment pursu- ant to this chapter. I. Remedies Not Exclusive. Remedies under this Chapter are in addition to and do not supersede or limit any and all other remedies, civil or criminal.
