15.44.070 <br />any provision of this chapter, or failure to comply with <br />any of the mandatory requirements of [his chapter shall <br />constitute a misdemeanor; except that notwithstanding <br />any other provisions of [his chapter, any such violation <br />constituting a misdemeanor under this chapter may, in <br />the discretion of [he operations services director, be <br />charged and prosecuted as an infraction or may be is- <br />sued an administrative citation. <br />G. Penalty for Violation. <br />1. Upon conviction of a misdemeanor, a person <br />shall be subject to payment of a fine or imprisonment, or <br />both, not to exceed [he limits set forth in California <br />Government Code Section 36901. <br />2. Upon conviction of an infraction, a person <br />shall be subject to payment of a fine, not to exceed the <br />limits set forth in California Government Code Section <br />36900. Subsequent violations may be charged as a mis- <br />demeanor. <br />3. Continuing Violation. Unless otherwise pro- <br />vided, aperson shall be deemed guilty of a separate of- <br />fense for each and every day during any portion of <br />which a violation of this chapter is committed, contin- <br />ued or permitted by the person and shall be punishable <br />accordingly as herein provided. <br />H. Authority to Arzest or Issue Citations. The <br />Operations services director shall have and are hereby <br />vested with [he authority to arrest or cite any person who <br />violates any section of this code in the manner provided <br />by the California Penal Code for the arzest or release on <br />citation of misdemeanor infractions as prescribed by <br />Chapters 5, Sc and Sd of Title 3, Part 2 of the Penal <br />Code (or as the same may be hereinafter amended). <br />The operations services director may issue a cita- <br />tion and notice to appear in the manner prescribed by <br />Chapter Sc of Title 3, Part 2 of the Penal Code, includ- <br />ing section 853.6 (or as the same may hereafter be <br />amended). It is the intent of the city council that the im- <br />munities prescribed in Section 836.5 of the Penal Code <br />be applicable [o public officers or employees or employ- <br />ees acting in the course and scope of employment pursu- <br />ant to this chapter. <br />I. Remedies Not Exclusive. Remedies under <br />this Chapter are in addition to and do not supersede or <br />limit any and all other remedies, civil or criminal.
