DEVELOPMENT DEFERMENT AGREEMENT <br /> <br /> TIllS DEVELOPMENT DEFERMENT AGREEMENT (the "Agreement") <br /> <br />is made this day of , 1984, by and between <br /> <br />FRANK AUF DER MAUR and CONRAD RICKENBACH ("Developer"), and <br />the CITY OF PLEASANTON, a municipal corporation ("City"). <br /> <br /> RECITALS ' <br /> <br /> A. Developer is the owner in fee of an approximately <br />3.34 acre parcel of real property (the "Property") located <br />in Pleasanton, California, designated as 3622 Old Santa Rita <br />Road (APN 946-1100-17), more particularly described in <br />Exhibit A attached to this Agreement. <br /> <br /> B. Developer has purchased and now has ou.tstanding <br />eight (8) D.U.Eo (Dwelling Unit Equivalent) sewer-system <br />connection permits ("Sewer Permits")for use in development <br />of the Property, such permits having been issued by the <br />Dublin-San Ramon Services District ("DSRSD") pursuant to <br />Alameda County Superior Court Orders in Civil Action No. <br />423134 filed December 19, 1972 and April 22, 1980 (the <br />"Court Orders"). <br /> <br /> C. Pursuant to the 1972 Court Order, building permits <br />must be obtained within three (3) years after purchase of <br />any sewer-system connection permits, or such sewer permits <br />shall be canceled. <br /> <br /> D. Paragraph 8 of Exhibit B to the Agreement, attached <br />to and incorporated in the 1972 Court Order, provides that <br /> <br /> <br />
