AGREEMENT <br /> <br /> THIS AGREEMENT is made and entered into on the day <br /> <br />of March, 1984, by and between CLYDESDALE PROPERTIES, a <br /> <br /> , (the "Owner") and the CITY OF PLEASANTON, <br />a municipal corporation (the "City"). <br /> <br /> W I T N E S S E T H: <br /> <br /> WHEREAS, Owner owns a parcel of land within the City of Pleasanton <br />as shown on Exhibit "A", attached hereto and by this reference <br />incorporated herein, and Generally identified as Lot 34 of Tract 4539 <br />or 605 Windmill Lane (the "Lot"); and <br /> <br /> WHEREAS, the City is the owner of a 10-foot--wide public service <br />easement (the "PSE") running along the southeasterly property line <br />of the Lot which contains a 36 inch RCP storm sewer line; and <br /> <br /> WHEREAS, prior owner has constructed a single-family dwelling <br /> <br />on the Lot which encroaches 4 feet into the PSE as shown on <br /> <br />Exhibit "A", attached hereto; <br /> <br /> NOW, THEREFORE, in consideration of the mutual covenants and <br />promises of the parties, the parties hereto agree as follows: <br /> <br /> 1. The City agrees to allow the existing structure to remain <br />which encroaches 4 feet 3 inches (±) into the PSE at the exterior <br />wall, as shown in Exhibit "A". <br /> <br /> 2. Owner agrees to reimburse the City for any extraordinary <br /> <br />costs incurred by the City, or any successor in interest of the <br />City to the storm sewer line located within the PSE, in the event <br />the storm sewer line requires maintenance, repair, and/or replacement <br /> <br /> <br />
