Valley <br /> <br />Pleasanton~ Dublin, <br />Livermore, and con- <br />tiguous unincorpor- <br />ated areas <br /> <br />The criterion for allocating the ACTEB resources to <br />these sub-areas shall be the same allocation cri- <br />terion as that prescribed in the controlling Fed- <br />eral legislation plus the general suh.-area popula- <br />ti<~ as com~red ts ~h.,-~ general ACTEB population. <br />These a]iocation criteria shall begin to be applied <br />in the fiscal year 1985. <br /> <br /> E. Insurance._ (I) Insurance Requirements. After execution of <br />~]~is amended agreement, ACTEB/ACAP"'shall promptly obtain, at its own <br />=c~xpense, all the insurance required by this section and shall submit <br />=~ complete Copy of Co~,!erage Verification signed by the ACTEB/ACAP's <br />{~'ent or broker to the ACTEB/ACAP members for review and approval. <br />~"ne insurance requirements must be met prior to commencement of any <br />work or other obligation pursuant to this agreement. <br /> <br /> The authorization to proceed with the work under the agreement <br />wlll not be issued, and the ACTEB/ACAP shall not commence work, <br />until such insurance has been approved by the ACTEB/ACAP members. <br />The ACTEB/ACAP shall not allow any contractor to commence work until <br />all similar insurance required of the contractor has been obtained. <br />Such insurance shall remain in full force and effect at all times <br />~uring the prosecution of the work and until the final completion <br />and acceptance thereof° <br /> <br /> (2) Workers' Compensation and Employer's Liability Insurance. <br />aCTEB/ACAP shall take out and maintain during the life of the <br />amended agreement Workers ' Compensation and Employer ' s Liability <br />Insurance for all of its employees to be engaged in work under the <br />amended agreement. Should any work be sublet, the ACTEB/ACAP shall <br />require the subcontractor similarly to provide Workers' Compensation <br />and Employer's Liability Insurance, all in strict compliance with <br />Federal and State laws and to fully protect t~he ACTEB/ACAP members <br />~,rom any and all claims arising out of occurrences on the work. <br /> <br /> (3) Public Liability Insurance. ACTEB/ACAP shall take out and <br />~aintain in the' name of ACTEB/ACAP ~nd ACTEB/ACAP members during the <br />~fe of the amended agreement~ such Public Liability Insurance as <br />~hail protect itself, ACTEB/ACAP members, officials, officers, <br />directors, employees, and agents, from claims which may arise from <br />~jperations '~.~nder this amended agreement, whether such operations be <br />~'>y itself~ by ACTEB/ACAP members, its officials, officers, direc- <br />~ors, employees, and agents, and contractor, or by anyone directly <br />~r indirectly employed by either of them. This liability insurance <br />shall inciude~ but shall not be limited to, protection against <br />,~laims arising from bodily and personal injury and damage to prop- <br />/~ r t~, res,a! ~ng fr'om ACTEB/ACAP ' s .~ ACTEB/ACAP members ' ~ or subcon~. <br /> <br /> <br />
