CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 84-116 ACCEPTANCE OF GPANT DEED FROM THE RO~%I CATHOLIC BISHOP OF OAKLAND FOR THE CONSTRUCTION OF THE BERNAL AVENUE UNDERPASS AT I~STERN PACIFIC RAILROAD WHEREAS, the Alameda County Right-of-Way Department has succeeded in acquiring on behalf of the City of Pleasanton a parcel of land from the Roman Catholic Bishop of Oakland, a corporation; and WHEREAS, this land is necessary for the construction of the Bernal Avenue underpass at the Western Pacific rail- road; and I~EREAS, staff has reviewed the documents and finds everything to be in order including the purchase price, which conforms to the appraisal accepted by the County on behalf of the City; and I~HEREAS, at its meeting of March 13, 1984, the City Council reviewed a report from the Director of Public Works and Utilities indicating that the acceptance of this Grant Deed is in the public interest; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASe]TON RESOLVES AS FOLLOWS: Section 1: Authorizes acceptance of the Grant Deed from the Roman Catholic Bishop of Oakland to the City of Pleasanton for purposes of construction of the Bernal Avenue underpass at the Western Pacific railroad. Section 2: Authorizes the City Manager to execute the Certificate of Acceptance of Real ProDertyo Section 3: Authorizes staff to deposit $91,920.00 into escrow for the purchase of said property. Section 4: Authorizes the Director of Public Works and Utilities to execute the Real ProDerty Purchase Contract. Section 5: This resolution shall become effective immediately upon its passage and adoption. THIS RESOLUTION ADOPTED MARCH 13, 1984 BY THE FOLLOWING VOTE:
