CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 84-116 <br /> <br />ACCEPTANCE OF GPANT DEED FROM THE RO~%I CATHOLIC <br />BISHOP OF OAKLAND FOR THE CONSTRUCTION OF THE <br />BERNAL AVENUE UNDERPASS AT I~STERN PACIFIC RAILROAD <br /> <br />WHEREAS, <br /> <br />the Alameda County Right-of-Way Department has succeeded <br />in acquiring on behalf of the City of Pleasanton a <br />parcel of land from the Roman Catholic Bishop of Oakland, a <br />corporation; and <br /> <br />WHEREAS, <br /> <br />this land is necessary for the construction of the <br />Bernal Avenue underpass at the Western Pacific rail- <br />road; and <br /> <br />I~EREAS, <br /> <br />staff has reviewed the documents and finds everything <br />to be in order including the purchase price, which <br />conforms to the appraisal accepted by the County on <br />behalf of the City; and <br /> <br />I~HEREAS, <br /> <br />at its meeting of March 13, 1984, the City Council <br />reviewed a report from the Director of Public Works <br />and Utilities indicating that the acceptance of this <br />Grant Deed is in the public interest; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASe]TON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Authorizes acceptance of the Grant Deed from the <br /> Roman Catholic Bishop of Oakland to the City of <br /> Pleasanton for purposes of construction of the Bernal <br /> Avenue underpass at the Western Pacific railroad. <br /> <br />Section 2: Authorizes the City Manager to execute the Certificate <br /> of Acceptance of Real ProDertyo <br /> <br />Section 3: <br /> <br /> Authorizes staff to deposit $91,920.00 into escrow <br />for the purchase of said property. <br /> <br />Section 4: Authorizes the Director of Public Works and Utilities <br /> to execute the Real ProDerty Purchase Contract. <br /> <br />Section 5: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED MARCH 13, 1984 BY THE FOLLOWING VOTE: <br /> <br /> <br />
