28. Except for retaining the three trees along the eastern portion of the driveway <br />(No.'s 22, 23, and 24 as defined in the tree report), all recommendations and <br />mitigation measures listed in the tree assessment provided by Traverso Tree <br />Service dated February 12, 2007, on file with the Planning Division, shall be <br />implemented. <br />29. Prior to building permit submittal, the applicants shall pay $4,000.00, the total <br />assessed value of the two removed heritage trees (No.'s 25 and 26), to the City's <br />Urban Forestry Fund and submit a cash bond in the amount of $17,470.00 for the <br />three retained heritage trees (No.'s 22, 23, and 24). The cash bond shall be <br />submitted to the Engineer or Planning Division and shall be released two years <br />after occupancy. <br />30. The applicants shall create a maintenance agreement between the property <br />owners and shall be reflected in the CC&R's that have the following language: <br />a. The property owner of unit 1 shall be responsible for the Black Walnut tree <br />(No. 22) and all other landscaping on the units property (e.g. front and side <br />yard landscaping); and <br />b. The property owner of unit 2 shall be responsible for maintaining the Black <br />and English Walnut trees (No.'s 23 and24). <br />Final language of this maintenance agreement shall be reviewed and approved by <br />the Director of Community Development and the City Attorney. <br />31. Installation time requirements: <br />a. Prior to building permit final, all front yard landscaping shall be installed <br />and inspected; and <br />b. Within 90 days of occupancy, all rear yard landscaping shall be installed. <br />Inspection from the Planning Division shall be required for both "a" and "b" listed <br />above. <br />32. The applicants and future homeowners are encouraged to use recycled gray <br />water, rain water, etc., for landscape irrigation. If used, the details shall be shown <br />on the building permit plan set to the satisfaction of the Director of Community <br />Development before issuance of a building permit. <br />33. The applicants and future homeowners are encouraged to use best management <br />practices for the use of pesticides and herbicides. <br />6 <br />
