BACKGROUND <br />The Political Reform Act requires every local government agency to review its conflict of <br />interest code biennially. The City Clerk and City Attorney have reviewed the City's <br />Code and determined that amendments are necessary in order to add, delete, or <br />reclassify the titles of various classifications so they are consistent with the organization <br />of the City government. <br />DISCUSSION <br />State law allows municipalities to adopt the Conflict of Interest Code by either resolution <br />or ordinance. To date, the City has chosen to do so by ordinance. For the reasons <br />listed below, staff now recommends that the Council repeal the current ordinance and <br />instead adopt a resolution to implement the conflict of interest code. <br />Most cities adopt a resolution (rather than an ordinance) to implement the conflict of <br />interest code. Unlike ordinances, which require a first and second reading at two <br />separate meetings and do not become effective for thirty days, resolutions are <br />considered at a single meeting and become effective immediately upon an affirmative <br />vote of the City Council. Moreover, there are little to no costs associated with the <br />adoption of a resolution. In contrast, every time the City amends an ordinance, it incurs <br />various fees and expenses in reprinting a new municipal code. Because the Political <br />Reform Act requires cities to review and amend the conflict of interest code a minimum <br />of every two years, staff believes the City can make these changes more efficiently and <br />save costs by adopting the attached resolution. The attached resolution replaces <br />Chapter 1.10 of the Municipal Code.
