Box 520 <br />Pleasanton, CA 94566 <br />LAND CONSERVATION CONTRACT <br />THIS CONTRACT, made and entered into this _ day of 2008, by and <br />between ,hereinafter referred to as "Owner," and the CITY OF <br />PLEASANTON, a municipal corporation pelitieal-subdivision of the State of California, <br />hereinafter referred to as "City": <br />WHEREAS, Owner possesses certain real property located within City and described in <br />Exhibit A attached hereto and made a part hereof; and <br />WHEREAS, said property is devoted to agricultural and compatible uses; and <br />WHEREAS, on February 5, 1976, said property was made subject to a land conservation <br />contract, entered into between Owner's predecessor in interest, the Estate of Ernest Ferrazio, and <br />the County of Alameda (the "County") pursuant to the California Land Conservation Act <br />(Government Code § 51200 et seq.) and filed in the Office of the Recorder of the County of <br />Alameda on February 26, 1976 in book 4272, page 180 (the "Initial Contract"). <br />WHEREAS, on ,the County of Alameda Local Agency Formation <br />Commission issued a Certificate of Completion finalizing City's annexation of said property. <br />WHEREAS, upon annexation of said property, the City succeeded to the County's rights <br />and obligations under the Initial Contract, pursuant to Government Code § 51243. <br />WHEREAS, to facilitate a lot line adjustment, the Owner and City desire to rescind the <br />Initial Contract and concurrently enter into in this contract, pursuant to and in accordance with <br />Government Code § 51257. <br />WHEREAS, at a properly noticed public hearing conducted on ,the City <br />Council of the City (the "City Council") adopted Resolution Number approving City's <br />execution of this contract, concun•ently rescinding the Initial Contract and, on the basis of <br />substantial evidence set forth in the administrative record, finding as follows: <br />(i) that this contract will enforceably restrict the adjusted boundaries of said property for <br />an initial term for at least as long as the unexpired term of the rescinded Initial Contract, but for <br />not less than ten (10) years; <br />(ii) that there is no net decrease in the amount of acreage restricted; <br />57286\124246v3 I <br />ATTACHMENT <br />
