3 <br />THE CITY OF <br />CITY COUNCIL AGENDA REPORT <br />j~L£~S~4NTONe <br />January 20, 2009 <br />Law Department <br />TITLE: RESCISSION OF AN EXISTING WILLIAMSON ACT CONTRACT AND <br />APPROVAL OF A REVISED WILLIAMSON ACT CONTRACT ON <br />PROPERTY WITHIN THE VINEYARD AVENUE CORRIDOR SPECIFIC <br />PLAN AREA <br />SUMMARY <br />A Williamson Act contract, which limits uses on property to agricultural related uses, <br />exists on 3.22 acres located east of Lot 30, Tract 7385, within the Vineyard Avenue <br />Corridor Specific Plan area (the "3.22-Acre Lot"). The Theobalds, who own Lot 30 and <br />the 3.22-Acre Lot, wish to extend a garage into a small sliver (.1 acre) of the 3.22-Acre <br />Lot which is permitted under the Williamson Act in order to facilitate a lot line adjustment <br />pursuant to the contract rescission process described in Government Code, Section <br />51257. In exchange for the City's rescinding the contract on the 3.22 acres, the <br />property owners have agreed to encumber a small portion (i.e., .1 acre) of Lot 30 <br />(currently not encumbered by a Williamson Act contract) and then reencumber the <br />balance of the 3.22-Acre Lot, thereby keeping intact the same amount of land subject to <br />the contract. See the attached map showing the two parcels. <br />RECOMMENDATION <br />Adopt the attached resolution rescinding an existing, and approving a revised, <br />Williamson Act contract on property within the Vineyard Avenue Corridor Specific Plan <br />area, and authorizing the City Manager to sign the revised contract. <br />FINANCIAL STATEMENT <br />There is no financial impact in this action. <br />
