CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 84-108 <br /> <br />A RESOLUTION OF NECESSITY TO ACOUIRE BY EMINENT <br />DOMAIN PROPERTY NEEDED FOR THE EXTENSION OF DEL <br />VALLE PARKWAY WESTERLY OF MAIN STREET <br /> <br />WHEREAS, <br /> <br />to facilitate improvement to the traffic circulation <br />system necessary for the central business district <br />and to complete the planned circulation system of <br />the General Plan for the downtown area, a Dlan for <br />the extension of the Del Valle Parkway between Main <br />Street and Hopyard Road has been aDproved by the <br />City Council; and <br /> <br />WHEREAS, <br /> <br />imDlementation of the extension of Del Valle Parkway <br />requires acquisition of private DroDerty; and <br /> <br />WHEREAS, <br /> <br />notice was given pursuant to Section 1245.235 of the <br />Code of Civil Procedure of the State of California <br />and a hearing was held at which time persons affected <br />had an opportunity to appear and be heard; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> The City Council finds that, Dursuant to Section <br />37350.5 of the Government Code of the State of <br />California authorizing the City of Pleasanton to <br />acquire property by eminent domain, all that land <br />described in Exhibit "A", attached hereto is <br />necessary for public use as a public street. <br /> <br />Section 2: <br /> <br /> The City Council declares that, with respect to <br />the proposed extension of the Del Valle Parkway, it <br />has found and determined that: <br /> <br />(a) <br /> <br />the public interest and necessity require the <br />proposed project; <br /> <br />(b) <br /> <br />the proposed project is planned and located <br />in the manner that will be most compatible <br />with the greatest Dublic good and the least <br />private injury; <br /> <br />(c) the property described in this resolution is <br /> necessary for the proposed Droject; and <br /> <br />(d) <br /> <br />an offer to acquire the property, meeting the <br />requirements of Government Code Section 7267.2, <br />has been made to the owner of record. <br /> <br /> <br />
