will be required to cease operations. Condition number 13 was modifed requiring the childcare <br />license to be obtained by June 30, 2009: <br />4. Until such time that a daycare license is obtained, no child 12 and under can participate <br />at the facility more than 16 hours per week and longer than the 12 week period as <br />outlined in the private recreation exemption section required by the States Child Care <br />Licensing Division. The applicant shall meet the paperwork, operations, and <br />requirements in accordance with the Child Care Licensing Division. <br />13. Tri-Valley Martial Arts Academy shall obtain a Child Care License from the Department <br />of Social Services by June 30, 2009. Said licensing and any applicable documentation <br />from Social Services shall be provided to the Planning Division. The teacher/employee <br />to children ratio shall be determined by the Department ofSocial Services to ensure <br />adequate supervision is provided <br />• Hours of Operation: <br />Staff evaluated the proposed hours of operation recommending a modification to allow <br />one-half hour before and after the proposed hours for set up and cleaning of the facility. <br />The Planning Commission supported the recommendation and conditioned the project as <br />follows: <br />5. No activities may be conducted beyond the hours as noted per condition of approval <br />number 4. The use of the facility for transitioning between classes may be open between <br />the hours noted above from 6:15 p. m. to 6.•45 p. m. There shall be a period of %: hour <br />allowed before and after the hours of operation, stated above, for patrons to leave and <br />the facility to be cleaned and set up for evening classes. <br />Staff recommends a further modification clarifying "no child 12 and under" to "no <br />children ages 5 to 12" to clarify that children under 5 years of age are not allowed <br />under the proposed conditional use. <br />For detailed information regarding the Planning Commission meeting, please refer to <br />the draft meeting minutes in Attachment 8. <br />OPTIONS FOR CONSIDERATION <br />The City Council has expressed concerns over time, related to providing the optimum <br />location and services to the youth in this community. The appeal of the decision also <br />raises similar questions. The following are three options the City Council may wish to <br />consider and discuss: <br />Oation 1 <br />The City Council directed the applicant in May, 2008 to consider redefining Tri-Valley <br />Martial Arts as a childcare facility and return to the City with an application for such <br />along with licensure from the State CCLD.
