CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 84-52 <br /> <br /> RESOLUTION VACATING EXCESS RIGHT-OF-WAY ON DEL <br /> VALLE PARKWAY <br /> <br /> WHEREAS, as part of the improvements to Del Valle Parkway, <br /> property was acquired from Margaret Simmons; and <br /> <br /> WHEREAS, pursuant to Section 8334 of the Streets and Highways <br /> Code, the City may summarily vacate excess rights- <br /> of-way not required for street purposes; and <br /> <br /> WHEREAS, the proposed vacation of the excess right-of-way <br /> is consistent with the goals and Policies of the <br /> General Plan; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> Section 1: Pursuant to Chapter 4, Part 3, Division 9 of the <br /> Streets and Highways Code and based upon the <br /> findings above, those portions of Del Valle Parkway <br /> shown in Exhibit "A", attached hereto and incorporated <br /> herein by this reference, are hereby vacated. <br /> <br /> Section 2: The clerk shall cause a certified copy of this <br /> resolution of vacation to be recorded in the <br /> office of the Alameda County Recorder and from and <br /> after the date the resolution is recorded, the <br /> street vacated no longer constitutes a street. <br /> <br /> Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> THIS RESOLUTION ADOPTED FEBRUARY 14, 1984 BY THE FOLLOWING <br /> VOTE: <br /> <br /> AYES: Councilmembers - Brandes, Mercer, Mohr, Wood and <br /> Mayor Butler <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br />/BvamEST: <br /> .ROBERT~. <br /> ~.~..,/.~/~ ~-~,~ E BUTLER, MAYOR <br /> Uames R.
