( i ) No Property Sewer Permits have <br /> been previously transferred, or will ever be <br /> transferred from Property to Parcel C. <br /> <br /> (ii) The Three Year Period for <br /> expiration of the transferred Parcel C Permits <br /> shall begin immediately upon such transfer. <br /> <br /> (iii) City shall be immediately <br /> notified of any such transfer. <br /> <br /> (iv) Any such transfer shall be in <br /> accordance with the terms of the 1972 Settlement <br /> Agreement. <br /> <br /> (v) Such transfer shall not be <br /> permitted unless Parcel C has been rezoned for <br /> commercial or industrial uses. <br /> <br /> (4) That each Property Sewer Permit is <br />an entitlement to 280 gallons per day of sewer capacity <br />notwithstanding any change in computation of Dwelling <br />Unit Equivalents. <br /> <br /> (5) That the three year period for the <br />Property Sewer Permits was tolled for a period of 311 <br />days from April 6, 1981 to February 11, 1982 (the <br />effective date of the PUD Approval) because prior to <br />February 11, 1982 the Property was zoned for <br />residential development and the City's Growth <br />Management Program precluded the Owner from obtaining <br /> <br /> 8 <br /> <br /> <br />
