CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 84-39 <br /> <br /> RESOLUTION APPROVING AGREEMENTS WITH MOZART <br /> DEVELOPMENT COMPANY AND FOOTHILL/SAB REGARDING <br /> PARCEL MAP 3702 <br /> <br /> WHEREAS, on October 11, 1983, a DevelOpment Deferment Agreement <br /> was entered into regarding the subject property; and <br /> <br /> WHEREAS, since that time final terms have been reached reKardin~ <br /> sale of the proDerty and the terms of the October 11, <br /> 1983 agreement are being aDDlied to two seDarate <br /> agreements on the subject proDertV; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> Section 1: The City Council approves the agreement between <br /> the City of Pleasanton and Foothill EnterDrises, and <br /> Mozart Development Company (Mozart Amended Development <br /> Deferment Agreement), a copy of which is attached <br /> hereto and incorporated herein by this reference. <br /> <br /> Section 2: The City Council approves the agreement between <br /> the City of Pleasanton and Foothill Enterprises and <br /> SAB Investments (Foothill/SAB Amended Development <br /> Deferment Agreement), a copy of which is attached <br /> hereto and incorporated herein by this reference. <br /> <br /> Section 3: Authorizes the Mayor to execute the above-described <br /> agreements. <br /> <br /> Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> THIS RESOLUTION ADOPTED JANUARY 24, 1984 BY THE FOLLOWING VOTE: <br /> <br /> AYES: Councilmembers - Brandes, Mercer, Mohr, Wood and <br /> Mayor Butler <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None ~t~?~.~~j <br /> TEST: <br /> <br /> ames R.
