CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 84-36 RESOLUTION VACATING EXCESS RIGHT-OF-WAY ON SANTA RITA ROAD WHEREAS, as part of the Santa Rita Road improvement project, a soundwall was constructed which ~arallels the roadway rather than conforms to the ~resent right- of-way boundary, thus creating an excess of right-of-way behind the wall; and WHEREAS, pursuant to Section 8334 of the Streets and Highways Code, the City may summarily vacate excess rights- of-way not required for street purposes; and WHEREAS, the proposed vacation of the excess right-of-way is consistent with the ~oals and policies of the General Plan; and WHEREAS, there are in place public utility facilities which are in use, and public convenience and necessity require the reservation of easements for these utility facilities; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Pursuant to Chapter 4, Part 3, Division 9 of the Streets and Highways Code and based upon the findings above, those portions of the Santa Rita Road right-of-way shown in Exhibit "A", except for easements reserved, are hereby vacated. A precise map showing the area to be vacated and the easements to be reserved is on file with the Engineering Division of the City of Pleasanton. Section 2: Those public service easements shown on Exhibit "A" as "Reserve for P.S.E." shall be reserved from the vacation of the excess right-of-way. Section 3: The clerk shall cause a certified copy of this resolution of vacation to be recorded in the office of the Alameda County Recorder and from and after the date the resolution is recorded, the street vacated no longer constitutes a street. Section 4: That area shown in Exhibit "A" is hereby declared to be surplus City land.
