CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFOrnIA <br /> <br /> RESOLUTION NO. 84-28 <br /> <br /> RESOLUTION ESTABLISHING PROCEDURE FOR MINOR RIGHTS- <br /> OF-WAY ADJUSTMENTS <br /> <br />WHEREAS, because Pleasanton has a general Dlan, state law <br /> requires that prior to acquisition or vacation of <br /> any street, the Planning Commission must render a <br /> report to Council as to the conformity of the <br /> acquisition or vacation with the general plan; and <br /> <br />WHEREAS, state law contains an exceDtion to this requirement <br /> if the City Council adoDts a resolution Providing <br /> that no Planning Commission review is required in <br /> the following circumstances: <br /> <br /> a. the disposition of the remainder of a larger <br /> Darcel which was acquired and used in Dart <br /> for streetpurDoses; <br /> b. acquisitions, dispositions, or abandonments <br /> for'street widening; or <br /> c. alignment projects; <br /> <br /> provided the above are of a minor nature; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: No Planning Commission review shall be required <br /> with respect to the acquisition or disposition of <br /> property for street purposes, street widening or <br /> alignment projects in the following circumstances: <br /> <br /> 1. the disposition of the remainder of a larger <br /> parcel which was acquired and used in Dart <br /> for street purposes; <br /> <br /> 2. acquisitions, dispositions, or abandonments <br /> for street widening; or <br /> <br /> 3. alignment projects, <br /> <br /> provided such dispositions for street purposes, <br /> acquisitions, dispositions, or abandonments for <br /> street widening, or alignment projects are of a <br /> minor nature. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
