CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 84-27 A RESOLUTION VACATING SANITARY SEWER EASEMENTS AND ACCEPTING A SANITARY EASEMENT WITHIN HACIENDA BUSINESS PARK WHEREAS, as part of the Hacienda Business Park improvements, the sewer line carrying sewage from south of the Arroyo Mocho to the East Amador trunk line was relocated to conform to lot line and in-street sewer line locations; and WHEREAS, the above relocation eliminates the necessity for a sanitary sewer easement along the line of the relocated sewer line shown in Exhibit "A", attached hereto and incorporated herein; and WHEREAS, subsequent to the acceptance of a sanitary sewer easement along the boundary of Lots 24 and 27 of Parcel MaD 3858, the sewer line was constructed within the area as shown in Exhibit "C", attached hereto and incorporated herein, due to an adjustment of the lot lines and a desire to keep the sewer line along the lot property line; no use of the sanitary sewer easement shown in Exhibit "B" attached hereto and incorporated herein, was ever made; and WHEREAS, pursuant to Section 8333 of the Streets and Highways Code, the City may summarily vacate easements super- seded by relocation and not in use; and WHEREAS, the proposed vacation conforms to the City's. general plan; and WHEREAS, it is in the interests of the public convenience and necessity to accept a sanitary sewer easement, as shown in Exhibit "C" (attached hereto and incorporated herein); NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Pursuant to Chapter 4, Part 3, Division ~ of the Streets and Highways Code and based upon the above findings, the sanitary sewer easements shown in Exhibits "A" and "B" are hereby vacated. - Section 2: The Clerk shall cause a certified copy of this resolution to be recorded in the office of the Alameda County Recorder and from and after the date the -1-
