CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 84-27 <br /> <br /> A RESOLUTION VACATING SANITARY SEWER EASEMENTS AND <br /> ACCEPTING A SANITARY EASEMENT WITHIN HACIENDA <br /> BUSINESS PARK <br /> <br /> WHEREAS, as part of the Hacienda Business Park improvements, <br /> the sewer line carrying sewage from south of the <br /> Arroyo Mocho to the East Amador trunk line was <br /> relocated to conform to lot line and in-street <br /> sewer line locations; and <br /> <br /> WHEREAS, the above relocation eliminates the necessity for <br /> a sanitary sewer easement along the line of the <br /> relocated sewer line shown in Exhibit "A", attached <br /> hereto and incorporated herein; and <br /> <br /> WHEREAS, subsequent to the acceptance of a sanitary sewer <br /> easement along the boundary of Lots 24 and 27 of <br /> Parcel MaD 3858, the sewer line was constructed <br /> within the area as shown in Exhibit "C", attached <br /> hereto and incorporated herein, due to an adjustment <br /> of the lot lines and a desire to keep the sewer <br /> line along the lot property line; no use of the <br /> sanitary sewer easement shown in Exhibit "B" <br /> attached hereto and incorporated herein, was ever <br /> made; and <br /> <br /> WHEREAS, pursuant to Section 8333 of the Streets and Highways <br /> Code, the City may summarily vacate easements super- <br /> seded by relocation and not in use; and <br /> <br /> WHEREAS, the proposed vacation conforms to the City's. general <br /> plan; and <br /> <br /> WHEREAS, it is in the interests of the public convenience and <br /> necessity to accept a sanitary sewer easement, as <br /> shown in Exhibit "C" (attached hereto and incorporated <br /> herein); <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> Section 1: Pursuant to Chapter 4, Part 3, Division ~ of the <br /> Streets and Highways Code and based upon the above <br /> findings, the sanitary sewer easements shown in <br /> Exhibits "A" and "B" are hereby vacated. <br /> <br />- Section 2: The Clerk shall cause a certified copy of this <br /> resolution to be recorded in the office of the Alameda <br /> County Recorder and from and after the date the <br /> <br /> -1- <br /> <br /> <br />
