EXIIIBIT "~" <br /> <br />1. That the process of conversion shall be in compliance with <br /> all provisions of Chapter 15, Title II of the Ordinance <br /> Code of the City of Pleasanton (Condominium Conversion <br /> Projects) attached hereto and made a part of this case by <br /> reference. <br /> <br />2. That a modification to the standard parking requirement be <br /> granted allowing for 39 of the required 188 spaces to be <br /> located partially on land owned by Zone 7 on the southern <br /> boundary of the project site (as shown on the attached <br /> site plan, Exhibit A) through a permanent license agreement <br /> between Zone 7 and the applicants and their successors. <br /> This agreement shall identify the City as a third party <br /> beneficiary. City approval shall be required prior to any <br /> party being able to revoke this license. <br /> <br />3. That the recommendations outlined in structural, heat loss, <br /> acoustical, and other technical reports be employed by <br /> the applicant to the satisfaction of the Building Official. <br /> <br />4. That the subdivision be processed through the tentative and <br /> final map procedures of the city. <br /> <br />5. That the developer be aware that additional requirements <br /> of subdivision may include but shall not necessarily be <br /> limited to the following: <br /> <br /> a. that the developer shall submit an on-site <br /> existing utility plan; <br /> <br /> b. that the developer shall submit for review and <br /> approval by the City, the proposed project CC&Rs, <br /> and an agreement that the homeowners association <br /> shall be responsible for the payment of water and <br /> sewer fees. <br /> <br />6. That prior to filing a final map, the developer shall <br /> execute and record an agreement, approved by the City <br /> Attorney, incorporating the terms and conditions of the <br /> conversion approval binding the developer and any successor <br /> in interestto provide the assistance to tenants and to <br /> improve the project in accordance with Chapter 15 of the <br /> Ordinance Code of the City of Pleasanton. The agreement <br /> shall be recorded and a copy shall be provided to each <br /> tenant occupying a unit on the date of approval of the <br /> condominium conversion project. The a~reement shall run <br /> to the benefit of any tenant occupying a unit on the <br /> date of the approval of the condominium conversion project <br /> and may require bonds to assure the completion of improve- <br /> ments in accordance with project approval. <br /> <br />7. That the developer shall meet all requirements of the City <br /> Fire and Building Codes and shall secure all necessary permits. <br /> <br />III <br /> <br /> <br />
