CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 84-16 <br /> <br /> RESOLUTION REGARDING CABLE TELEVISION PROBLEMS <br /> <br /> WHEREAS, it has come to the Council's attention that there <br /> are still some leakage problems in that nonsubscribing <br /> households are in receipt of the Playboy Channel; <br /> and <br /> <br /> WHEREAS, at its meeting of January 9, 1984, Council considered <br /> this problem; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> Section 1: The City Council reaffirms its position that <br /> receipt of the Playboy Channel by nonsubscribing <br /> households is a violation of the City's Franchise <br /> Ordinance which requires that the system shall be <br /> installed and maintained in accordance with the <br /> "highest and best accepted standards of the industry." <br /> <br /> Section 2: If Viacom cannot correct the problem by March 1, <br /> 1984, or submit an acceptable plan for correcting <br /> the problem, or demonstrate that the problem does <br /> not exist, then Viacom may be declared to be in <br /> willful violation of the Franchise Ordinance and <br /> may be subjectto franchise revocation. <br /> <br /> Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> THIS RESOLUTION ADOPTED JANUARY 9, 1984 BY THE FOLLOWING <br /> VOTE: <br /> <br /> AYES: Councilmembers - Brandes, Mercer, Mohr, Wood and <br /> Mayor Butler <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br />~ames R'Y'W~i~er, CitS~ CI~fk ~' <br /> <br /> Peter D.
