On July 28, 2015,the parties agreed to
extend the closing date to October 30, 2015 to permit further groundwater testing required by the ^
Regional Water Quality Control Board that is necessary for the regulatory remediation process on an \
adjacent service station, conditional closure of which is a condition of the sale of Segment 7. By this
letter, the County and City seek to memorialize their agreement pursuant to section 1.8 of the Agreement
to extend the term of the Second Closing Date with respect to Segment 7 by 3 months to a new Second u'
Closing Date of February 1, 2016.
This extension of time will permit the Regional Water Quality Control Board time to review the recent
ground water testing results, and process conditional closure of the regulatory remediation matter,
including a public notice period.
The parties further agree to meet and confer prior to the new expiration of the Second Closing Date with
respect to Segment 7 to determine whether additional extensions of time are necessary or desirable.
By signature below, each party confirms the extension of the Second Closing Date with respect to
Segment 7 of the Transportation Corridor to February 1, 2016, as further described above.
COON, OF ALAMED CITY OF PLEASANTONU
I 1
By: .44 r, • By:
Scott Haggerty, President Nelson Fialho
Board of Supervisors City Manager
County of Alameda City of Pleasanton
Approved as to form: Approved as to form:
Donna R.
