EXHIBIT 5: Letter from Catholic Cemeteries <br />June 15, 2006 <br />Mr. Robert Seelig <br />Director <br />Catholic Cemeteries of the <br />Diocese of Oakland <br />1965 Reliez Valley Road <br />Lafayette, CA 94549 <br />RE: PLEASANTON MEMORIAL CEMETERY <br />Dear Robert: <br />The City of Pleasanton has asked that I verify with you in writing the discussions we <br />have had relative to the Diocese role in the future operations of the Cemetery. This <br />letter will summarize the concepts for your review and acknowledgement. <br />The plan would be for the City or a Foundation to contract with Catholic Cemeteries for <br />you to: <br />a. Maintain the books and records of the cemetery and automate these <br />records into your system over time. <br />b. Provide for customer service for all inquiries about the cemetery and its <br />services including the sale of burial rights and interment service <br />scheduling. <br />c. Provide for the remaining burials and memorial foundations to be placed <br />in the cemetery. <br />d. Assist the City and the Foundation in determining the best use for any <br />undeveloped parcels in the Cemetery understanding your preference is to <br />close the Cemetery to new burials as soon as practical. <br />For such services, the Diocese will receive 100% of the fees assessed for interments <br />and memorial foundation and installation services. Further, the Diocese would receive <br />30% of the sale of burial rights, if any.
