The primary benefit of this Option 1 is its immediate implementation. <br />2. PP and QQ policies into the General Plan + Administrative Guidelines. <br />As Measures PP and QQ have become law, their policies have been placed into the <br />General Plan (and will be placed into the General Plan update). .This Option 2 <br />envisions the City Council directing staff to develop administrative guidelines to assess <br />projects to enforce Measures PP and QQ. For example, a guideline may involve City <br />staffs use of the City's existing geographic information system (GIS) to map hill area <br />contours to determine the location of slopes of 25% or greater. Such guidelines could <br />not modify the specific regulations of Measures PP and OO but might assist property <br />owners in understanding in advance the regulations to which they are subject, and how <br />those regulations will be applied. <br />The primary benefit of this Option 2 is greater understanding of the Measures' <br />requirements by property owners in advance of submitting a development application, <br />but preserving for City staff the ability to utilize new information and tools. <br />3. PP and OO policies into the General Plan + Detailed Formal Ordinance. <br />As noted above, Measures PP and OO are law, and their policies must be incorporated <br />into the General Plan/General Plan update. This Option 3 requires the City Council to <br />direct staff to begin a process to draft more formal rules to enforce Measures PP and <br />QQ by an implementation ordinance. Any ordinance would need to be considered by <br />the Planning Commission, City Council, and be subject to review under the California <br />Environmental Quality Act (CEQA) before adoption. While an ordinance might provide <br />property owners with greater certainty, a formal ordinance loses some ability to respond <br />to new information, as any modification of the ordinance would require the formal <br />Planning Commission and City Council approval process. Again, such an ordinance <br />could not modify the specific regulations of Measures PP and QQ. <br />The primary benefit of this Option 3 is more certainly for property owners and the public, <br />but in exchange, the ability to quickly use new tools and information may be lost, and <br />the development of such an ordinance and related CEQA review would likely take many <br />months. <br />4. PP and QQ policies into the General Plan + Public Stakeholders Process to <br />Develop Hill Side and Ridge Protection Ordinance and Design Guidelines. <br />Again, Measures PP and QQ must be incorporated into the General Plan/General Plan <br />update. However, this Option 4 would expand that action to include a public process to <br />develop a hillside protection ordinance and design guidelines as generally described in <br />Measure QQ. Council could direct staff to return with a proposed membership for a task <br />force and a scope of work (which would not be intended to modify the specific <br />regulations of Measures PP and QQ).
