15 <br />THE CITY OF <br />-~- ~"' CITY COUNCIL AGENDA REPORT <br />[~L£~S~4NTONo <br />December 16, 2008 <br />City Manager's Office <br />City Attorney's Office <br />Community Development <br />TITLE: INFORMATIONAL REPORT REGARDING THE EFFECTS OF THE <br />PASSAGE OF MEASURES PP AND QQ AND NEXT STEPS FOR <br />IMPLEMENTATION <br />SUMMARY <br />Measures PP and QQ have both been approved by the voters. Each measure adopts <br />General Plan policies restricting hillside development, and also defines a housing unit <br />for purposes of the City's housing cap. This report analyzes whether any provisions of <br />Measures PP and QQ are in conflict, as Measure PP would control because it received <br />the higher number of votes. This report also discusses four options for implementation. <br />For each of these options, the City Council first would place the Measures PP and QO <br />policies into the current General Plan (to the extent OO's policies are already not in the <br />current General Plan), as well as the proposed General Plan update; and <br />1. Apply these policies (to the extent applicable) to projects during the normal public <br />review process before the Planning Commission and City Council without further <br />need of guidelines, an ordinance, or appointing a committee of stakeholders to <br />propose an ordinance and design guidelines. <br />2. Direct staff to develop administrative guidelines to implement the policies, with <br />the intent of providing applicants greater certainty regarding requirements arising <br />from the measures. <br />3. Direct staff to develop an ordinance setting forth the requirements of Measures <br />PP and OO in a more detailed and formal manner. <br />4. Direct staff to return with a proposed process for a committee of stakeholders to <br />develop a hill side and ridge protection ordinance and design guidelines which <br />complies with the specific restrictions adopted by Measure PP and the broader <br />policies of Measure OO. <br />
