CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 84-06 RESOLUTION ACCEPTING DEED AND RIGHT-OF-WAY PURCHASE CONTRACT FOR DUBLIN CANYON ROAD (BUENO PROPERTY) WHEREAS, Council approved a widening plan for Dublin Canyon Road which is being accomplished through Assessment District 1982-1 and the City Attorney commenced an eminent domain proceeding to acquire the necessary land; and WHEREAS, the City is in receipt of a court order authorizing the conservator (Crocker Bank) to compromise the claim and execute a deed and the Real Property Purchase Contract between Crocker Bank and the City of Pleasanton; and WHEREAS, staff has reviewed the documents and finds everything to be in order including the purchase price, which conforms to the appraisal accepted by the City; and WHEREAS, at its meeting of January 9, 1984, the City Council reviewed a report from the Director of Public Works - and Utilities indicating that the acceptance of this Deed is in the public interest; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Approves the Real Estate Purchase Contract between Crocker Bank and the City of Pleasanton and authorizes the Director of Public Works and Utilities to execute the Real Estate Purchase Contract. Section 2: Authorizes the payment of $47,850.00 from Assessment District 1982-1 funds into an escrow with Western Title Insurance Company. Section 3: Authorizes acceptance of the Conservator's Deed from Crocker Bank to the City of Pleasanton for the necessary rights-of-way, a copy of which is attached hereto and incorporated herein by this reference. Section 4: Authorizes the City Attorney to take whatever action is necessary to finalize this transaction. THIS RESOLUTION ADOPTED JANUARY 9, 1984 BY THE FOLLOWING VOTE:
