CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 84-06 <br /> <br /> RESOLUTION ACCEPTING DEED AND RIGHT-OF-WAY PURCHASE <br /> CONTRACT FOR DUBLIN CANYON ROAD (BUENO PROPERTY) <br /> <br /> WHEREAS, Council approved a widening plan for Dublin Canyon <br /> Road which is being accomplished through Assessment <br /> District 1982-1 and the City Attorney commenced <br /> an eminent domain proceeding to acquire the necessary <br /> land; and <br /> <br /> WHEREAS, the City is in receipt of a court order authorizing <br /> the conservator (Crocker Bank) to compromise the <br /> claim and execute a deed and the Real Property Purchase <br /> Contract between Crocker Bank and the City of <br /> Pleasanton; and <br /> <br /> WHEREAS, staff has reviewed the documents and finds everything <br /> to be in order including the purchase price, which <br /> conforms to the appraisal accepted by the City; and <br /> <br /> WHEREAS, at its meeting of January 9, 1984, the City Council <br /> reviewed a report from the Director of Public Works <br />- and Utilities indicating that the acceptance of this <br /> Deed is in the public interest; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> Section 1: Approves the Real Estate Purchase Contract between <br /> Crocker Bank and the City of Pleasanton and authorizes <br /> the Director of Public Works and Utilities to execute <br /> the Real Estate Purchase Contract. <br /> <br /> Section 2: Authorizes the payment of $47,850.00 from Assessment <br /> District 1982-1 funds into an escrow with Western Title <br /> Insurance Company. <br /> <br /> Section 3: Authorizes acceptance of the Conservator's Deed <br /> from Crocker Bank to the City of Pleasanton for the <br /> necessary rights-of-way, a copy of which is attached <br /> hereto and incorporated herein by this reference. <br /> <br /> Section 4: Authorizes the City Attorney to take whatever action is <br /> necessary to finalize this transaction. <br /> <br /> THIS RESOLUTION ADOPTED JANUARY 9, 1984 BY THE FOLLOWING VOTE: <br /> <br /> <br />
