CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 84-04 <br /> <br /> RESOLUTION OF INTENTION TO VACATE A PORTION OF A <br /> SANITARY SEWER EASEMENT WITHIN HACIENDA BUSINESS <br /> PARK <br /> <br />I~EREAS, a certain portion of the easement containing a <br /> sanitary sewer line installed to serve the Amberwood <br /> residential development has become unnecessary for <br /> present or prospective use due to the relocation <br /> of the sewer line as Dart of the Hacienda Business <br /> Park improvements; and <br /> <br />WHEREAS, it is necessary for the City of Pleasanton to <br /> vacate that portion of the sewer easement pursuant <br /> to the requirements of Section 8320 et seq. of <br /> the Streets and Highways Code of California; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Pursuant to Section 8320 et seq. of the Streets <br /> and Highways Code of California, the City Council <br /> hereby declares its intention to vacate a Dortion <br /> of the 10 foot wide sanitary sewer easement unnecessary <br /> for present or prospective public use, said portion <br /> being an approximately 2008 foot long easement <br /> running from the Arroyo Mocho northerly to the <br /> intersection of the Southern Pacific Railroad <br /> right-of-way and Tassajara Creek, more particularly <br /> shown on Exhibit "A" attached hereto and by this <br /> reference incorporated herein. A map showing the <br /> precise location of the easement is on file with <br /> the Engineering Division of the City of Pleasanton. <br /> <br />Section 2: A public hearing shall be held on January 24, <br /> 1984, at 8:00 P.m. in the City Council Chambers at <br /> 200 Old Bernal Avenue, Pleasanton, California, at <br /> which time public testimony will be taken with <br /> regard to the City's intention to vacate the <br /> portion of the sewer line easement described <br /> above. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED JANUARY 9, 1984 BY THE FOLLOWING <br />VOTE: <br /> <br /> <br />
