WHEREAS, this City Council must deliver such Policy Report to the <br /> Secretary of the United States Treasury ("Secretary") on <br /> or before December 31, 1985; and <br /> <br />WHEREAS, a notice of public hearing containing information <br /> regarding the public hearing and the availability of the <br /> proposed and final Policy Report was published at least <br /> fourteen (14) days before the date set for such public <br /> hearing, in a newspaper of general circulation in the <br /> City of Pleasanton; and <br /> <br />WHEREAS, this City Council held said public hearing, at which <br /> time an opportunity was provided to present arguments <br /> both for and against the publication of the Policy <br /> Report and the nature of the contents of the Policy <br /> Report; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: This City Council does hereby find and declare that <br /> the above recitals are true and correct. <br /> <br />Section 2: The proposed form of Policy Report presented to this <br /> meeting of the City Council is hereby approved and <br /> adopted by the City. The Mayor of the City of <br /> Pleasanton is hereby authorized and directed to execute <br /> such Policy Report on behalf of the City Council, with <br /> such changes therein as he may approve, such approval to <br /> be conclusively evidenced by his execution of such <br /> Policy Report. <br /> <br />Section 3: The appropriate officers of the City are hereby <br /> authorized and directed to mail such Policy Report by <br /> the United States Postal Service, certified mail, return <br /> receipt requested, to the Secretary, to be postmarked on <br /> or before December 31, 1985. <br /> <br />Section 4: It is the purpose and intent of this City Council <br /> that this resolution constitute approval of the Policy <br /> Report by the applicable elected representative in <br /> accordance with Section 103A(j) of the Internal Revenue <br /> Code of 1954, as amended. <br /> <br />Section 5: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
